Issue: Sexual Harassment/Discrimination

Immediate Actions

  • Stop the actions
  • Advise that this is a direct violation of
    • SOPS (02.00.04 Sexual Harassment/02.00.05 Discrimination)
    • Rules and Regulations (100.6 Human Relations)
    • The law
  • State that this will “stop immediately”
  • Ask employee if they can continue to work in the environment
  • Place units out of service
    • Adjust staffing if needed

Investigate

  • Written statements from complainant, respondent, and all witnesses
  • Meet with complainant and respondent privately
    • Listen, acknowledge complaint, take notes
    • Review SOP 02.00.04 Sexual Harassment/02.00.05 Discrimination with employee
    • Advise employee to contact EEO Officer/Counselor for guidance meeting
      • Formal vs. Informal process
      • FRD-403 EEO/AA Intake form
    • Previous occurrences?
  • Meet with alleged respondent
  • Review personnel files

Notify

  • Battalion Management Team (BC and EMS Supervisor)
  • EEO Officer/Counselor within 24 hours

Document

  • Supervisors notes (names, date, time)
  • Informal
    • Alternative Dispute Resolution
    • Resolution agreement (EEO Counselor)
    • Possible discipline

Follow up

  • Progressive discipline based on EEO findings
  • Contact EEO office for shift training
  • Delegate training for the shift to LT or Master Technician on SOPs, station policies, and ways to prevent future occurrences
    • Review training in 3 working days, have the training delivered in 6 working days
  • Follow up with employees about the work environment periodically for next 2-3 months
