Upon Taking a Person into Custody

A
  • Inform prisoner of authority and cause for arrest, unless physical resistance, flight or other factors. Immediately field search/frisk prisoner and search adjacent vicinity for weapons, evidence and/or contraband.
  • Verify by a Superivisor
  • Remove prisoner to precinct of arrest and inform the desk officer of charges
  • If the arrest is effected by an off-duty uniformed member of the service, the desk officer will request the commanding officer/duty captain to respond to the stationhouse and verify arrest.

  • if there is a fiberglass partition the prisoner will be seated behind the operator. This will allow the recorder to maintain visual contact with the prisoner. – If RMP is not equipped with a partition, the recorder will ride in rear seat, directly behind the operator, with the prisoner seated on passenger side of vehicle.

Strip Search

A
  • A strip search is defined as any search in which an individual’s undergarments and or private areas are exposed or in which an individual’s clothing is removed
  • only be conducted with the knowledge and approval of the arresting officer’s immediate supervisor or the borough Court Section supervisor.
  • May only be strip searched when the arresting officer reasonably suspects that weapons, contraband or evidence may be concealed upon the person or in the clothing in such a manner that they may not be discovered by previous search methods.

  • to determine the necessity of a strip search are: serious violent felony, arrest circumstances, subject’s reputation, unaccounted for “hits” on magnetometers or walk through metal detectors
  • A strip search shall be conducted only by a member of the same gender, in utmost privacy.

Prisoner Cellular Phones

A
  • Obtain IMEI number from the sticker in the battery compartment in the rear of the cellular telephone or from the sticker on the rear of the cellular telephone viewing screen.
  • If the IMEI number has been removed or defaced, the cellular phone will be invoiced as “Investigatory Evidence”
  • Photocopy the area of the cellular telephone listing the IMEI number and attach to Online Booking System Arrest Worksheet.

Fingerprint

A

 Never take prints when alone
 Weapons (guns, pepper spray, and batons) should be secured
 Check fingerprinting area for potential weapons prior to taking prints
 Never leave the prisoner alone or unattended before
 Never cuff the prisoner to portable objects (such as chairs)
 Never attempt to force prints if the prisoner resists or is intoxicated
 Never leave items such as keys, pens, etc. within prisoner’s grasp

A Medical Treatment of Prisoner form will be prepared for a prisoner who requires medical aid or psychiatric treatment

Sick or Injured at Arrest Scene

A
  • Request an ambulance and remove prisoner to hospital directly from place of arrest, if necessary
  • UNDER NO CIRCUMSTANCES will a prisoner who has ingested a narcotic or other dangerous substance be transported to the command
  • When a prisoner is taken directly to the hospital from the scene of arrest, remember to search the prisoner in front of witnesses and to search their clothing once they are removed by hospital authorities
  • Leg restraints MUST be used when transporting a prisoner that has refused to be fingerprinted, and for ALL prisoners being transported to a hospital for medical treatment.

Procedures When Guarding a Prisoner at the Hospital

A
  • stay alert and never let down your guard.
  • Keep prisoners rear handcuffed whenever possible and double lock the cuffs
  • Never leave prisoners unattended
  • Keep your prisoner under constant observation to prevent escape
  • Utilize a second pair of handcuffs to handcuff prisoner’s free wrist to a bed
    or gurney, before removing first pair of handcuffs for treatment

Procedure When a Prisoner is Admitted to a Hospital

A

When a prisoner is admitted to a hospital you must notify the desk officer, precinct of arrest. You must also request the desk officer – of the precinct where the hospital is located – to provide relief.
