What do we need to be careful of when we know a person has Previous convictions?

A

Just because a person has previous convictions for an offence doesn’t give you sufficient grounds for suspicion.

A

You do not have to say anything

But it may harm your defence, if you do not mention, when questioned, something which you may later rely on in court.

Anything you do say may be given in evidence.

Arrested person must be informed immediately that they are free to go.
Full and detailed PNB entry needs to be completed that explains the circumstances, grounds & necessity for arrest and why the grounds & necessity no longer apply.
