Affirmative Action Programs
Correct imbalances in employment that exist directly as a result of past discrimination
Bakke Case
Bakke (white man) refused admission due to spots held for blacks. He sued, and won b/c of rigid quotas and excluding nonpreferred groups from competition.
Brown V. Board of Education
Supreme Ct decided racially segregated schools as unconstitutional.
Civil Rights Act (1964)
Prohibits all discrimination based on race, color, sex, religion or national origin. Includes Title VII
Comparable worth
Women have been directed into certain occupations and held back by a biased wage system. Women should be paid on same scale for doing same or equivalent jobs or different jobs involving equal skill, effort, responsibility.
EEOC
Enforces civil rights, discrimination and equal employment acts.
Grutter & Gratz cases
Grutter: Affirmative action upheld at Univ of Michigan law school to promote diversity.
Gratz: Michigan’s undergrad affirmative action program deemed unconstitutional. Gave minorities a 20 pt bonus
Hostile work environment harassment
Doesn’t involve pressure for sexual behaviors, but sexual innuendos: emails, pics, remarks, touching, etc.
Job discrimination
Employment decisions harm or disadvantages employee or applicant. Decision based on person’s membership of certain group, rather than individ merit. Decision rests on prejudice, false stereotypes or assumption the group is inferior.
Pink-collar occupations
Poor paying jobs for women.
Quid Pro Quo harassment
Supervisor makes employee’s job conditional. “This for that”
Sexual favoritism
Receiving discrimination for not sleeping with boss.
Sexual harassment
Unwelcome sexual advances, requests for sexual favors & other verbal or physical conduct of sexual nature
