How many freedoms of the air are there?

What is the first freedom?
The right granted by one state to another state to fly across its territory without landing
What is the second freedom?
The right or privilige granted by one state to another state to land in its territory unscheduled for non-traffic purposes
eg. technical stop
What is the third freedom/
The right…., for aircraft to put down traffic from the home state of the carrier
eg. going from A-B
What is the fourth freedom?
The right…’ for carriers to take on traffic with the destination being that of the home carrier
eg. going from B-A
What is the fifth freedom?
The right…’ For a carrier to land then take on new or extra traffic which is destined for a third state
eg. Aircraft from A landing in B then going on to C
What do the first two freedoms come under?

When was the convention of Warsaw?
1929
What was the purpose of the Warsaw convention?
It resulted in rules governing air carriers liability in respect of the international air carriage of persons, baggage or cargo performed for reward
eg. regulatedb compensation for loss/death whilst onboard an aircraft
When was the convention of Rome?
1933
What was the purpose of the treaty/convention of Rome?
It attempted to unify widely differing national laws regarding the liability of the ower or operator of the aircraft which was caused damage to Third partes on the surface by foreign aircraft
eg. if a box fell out of a plane and hit you
When was the Montreal Convention?
1999
What was the purpose of the Montreal convention?
It estabilished that ‘a carrier may stipulte that the contract of carriage shall be subject to higher limits of liability thn provided for in this convention or to no limits at all
eg. it modifies the numbers for compensatin from the previous conventions
When was the tokyo convention?
1963
What was the purpose of the Tokyo convention?
The talks were to establish the means in which safety needed to be upheld upon an aircraft.
It was made unlawful ‘ to commit acts which, whether or not they are offences (against the penal law of state) may or do jeopardise the safety of an aircraft or of persons on board or property therein which jeopardise good order and discipline onboard. - whilst the aircraft is in flight
What did the toyko convention state about crew and the public on board whilst there is an incident?
Crewmembers are required to assist, if necessary, while passengers may be asked to help, but are not required to do so.
What is said about the landing if there is an incident onboard?
The aircraft commander may disembark in the territory of any state in which the aircraft lands, any person, who he has reasonable grounds to believe has committed, or about to commit, on board the aircraft, an act covered in this covention
What was said about notfiying territories if an incident means the aircraft needs to land
As soon as practical and if possible before landing in a contracting state with an ‘offender’ on board, the PIC shall notify the authorities of the state of his intention to diesembark the ‘offender’ and why
