What is a contract
An agreement between two or more people, intended to be enforced by law
What are the types of contracts and give an example of each
Written (sign on paper) , verbal (“ I owe you”) and tacit (products sold are in working condition
What are parties to a contract
Those people who have reached an agreement

What is offer and acceptance in contracts
Both parties must understand the terms of the contract to be the same thing
What is consideration in contracts
Something of value must me exchanges
What is the intention In contracts
Intended for agreement to be legally bound
What is capacity in contracts
Both parties must be legally able to enter contract (not under any influence)
What is form in contracts
Any legal forms required must be completed
What is genuine consent in contracts
Parties should not be forced or under threat to enter contract
What is legality of purpose in contracts
Contract must not be for an illegal purpose
What is the possibility of performance in contracts
Must be possible for contract to be fulfilled
What should contracts include
- full names of parties to the contract
- details of agreement
- consequences of contract is broken
- signature of all parties with date and place of signing
What are the rights and responsibilities of a contract
- the contract is enforcable by law
- any products must be in working condition
- if there is a breach of contract other party must compensate the other for any loss incurred
- if a contract is signed outside the place of business, there is a five day cooling period to cancel the contract
What is a plaintiff
A person who brings a case against another in a court of law
What is a defendant
An individual, company, or institution sued or accused in a court of law
What is legally binding
Enforced by law
What is contractual capacity
The ability of a person to enter a contract
What does an employment contract contain
- Job title and job description
- remuneration
- benefits
- hours of work and overtime
- leave
- details of employee
What makes contracts defective
If they are:
- void
- voidable
- unenforceable
What is a void contract and an example
A contract that isn’t legally enforceable, starting from the time it was created
Eg. A contract to poach rhinos
What is a voidable contract and an example
A contract may be rendered voidable if any party was mentally incompetent
Eg being forced to sign over your property through blackmail
What is an unenforceable contract and an example
A contract concluded but is not enforceable by law
Eg. A bet with your friends for 100 rands that you can eat 20 hotdogs in 60 seconds
What is a breach in contract
A failure, Without legal excuse, to perform any promise that forms all or part of the contract
