Standard of Care
- how we as emts care for patients
- “ was the behavior of an EMT and the care provided the same if it would have been provided by any other reasonable EMT in a similar circumstance “
Consent may be expressed
- verbal or not
- the patient is agreeable to ur consent
Consent may be informed
where the emt educates a patient about the risks benefits and alternatives of a given procedure before obtaining their consent
Implied Consent
consent of minors - if patient is not there consent is applied
consent of people not able to make a rational decision - if the patient has an injury it they are intoxicated
Getting Consent
parents are the ones to give consent and refuse care if patient is not present and implied treat and transport
Emancipation
patient is fully emancipated and can give consent
- has a child
- is married
- is self supporting
- in the military
Restraining a Patient
- always call help from patient
- a medical disease can cause the patient to act a certain way
- verbal de escalation is not successful then apply sort restraints such as towels, triangular bandaged or commercially available soft medical restraints
- then assess patient
Concerns when using restraints
- public perception
- how is the patient positioned ( best position is supine position )
- judicious force
Abandonment
- the unilateral termination of care without ensuring a continuation of care by a provider of equal or greater scope of practice
False imprisonment or kidnapping
taking away by force
Assault and Battery
unlawfully placing a person in the threat of bodily harm, unlawfully touching someone
Civil Tort
a wrongful act that gives rise to a civil suit
- not within the jurisdiction of US criminal courts
- the goal is to provide compensation to victims for wrongdoing against them
Negligence
4 factors
1) was the officer on duty
2) breach of duty ( failed to act or acted in a way that shouldn’t have been acted in
3) damages ( physical emotional or property
4) causation ( proximate causation )
Refusal of Care
- EMT has to have a conversation with the patient
- ensure that patient understands the limitations of EMS evaluation
- the patient should be given information if they change their mind they can call back 911 ( make sure emt documents this )
Breach of Privacy - Libel
false information it was written
Breach of Privacy - Slander
false information that was spoken
Advanced Directives
- written instruments to serve to tell other of a patients wishes if they become unable to express them on their own
Acceptable forms of advanced directives
- do not resuscitate order
- DNR bracket
- M.O.L.S.T FORM
- health care proxy
Non acceptable forms of advanced directives
- living wills
- power of attorneys
SCAM report
nys emts are mandated reporters for suspected child abuse or maltreatment
- use form DSS - 2221 - A
Crime scenes
when operating at a crime scene ensure that you refrain from touching anything not associated with patient care
Standard of care is a combination of
- state protocols
- public health law
- educational standards
