what is the Ontario Occupational Health and Safety Act
When a person is convicted of an offence under OHSA they are subject to;
A fine of up to $1,500,000 for a corporation
A fine of up to $1,500,000 directors and officers and/or 12 months in jail
A fine of up to $500,000 for all other persons and/or 12 months in jail
what are the Psychological and Physical Health Hazards?
Harassment and Violence - caused by people in the environment
Physical agents - exposure to physical element
Biological agents - exposure to natural organisms
Ergonomically related - caused by environment
what is Assumption of Risk?
In the assumption of risk, the belief is the employee understands
the risk of injury involved in a certain activity
the unsafe practices of the occupation
and agrees to take the risk on
what is a Careless Worker?
an early approach to safety in the workplace which assumed accidents were due to workers’ carelessness.
what is Shared Responsibility?
A newer approach to workplace safety that relies on the cooperation of the employer and employees.
what is the Westray Bill?
Established new legal duties for workplace health and safety, and imposed serious penalties for violations that result in injuries or death
Bill provided new rules for attributing criminal liability to organizations including orgs, and their representatives
what do you do if There is an Accident?
Call 911
Administer first aid if possible
Secure and manage the scene
Report the incident → to police, management, OHS, and the union if
needed
Conduct an investigation → gather evidence, interview witnesses
Create a final report → make recommendations
Follow up → implement changes
