What is legislation?
- a collection of laws passed by parliament which state the rights and entitlements of individuals and organisations
The Care Act 2014:
- duty on local authorities to promote an individuals wellbeing +carry out child need assessments
- continuity of care
- an independent advocate to be available
- adult safeguarding
The Health and Social Care Act 2012:
- ‘No decision about me, without me’
- health and wellbeing boards
- public health
- healthwatch
What does ofsted do? (main role)
carries out inspections that rate child care settings and schools from ‘outstanding’ to ‘inadequate’.
What does ofsted publish?
- inspection reports that identifies good practice and indicate what needs to be improved
- can put failing schools into special measures and can re-inspect them to monitor progress and improvements
Which aspects are inspected by ofsted?
- effectiveness of leadership and management
- effectiveness of safeguarding
- outcomes for children and learners
- personal development, behaviour and welfare
- quality of teaching, learning and assessment
Role of the CQC (Care quality commission)
- carries out inspections of health and social care settings to monitor care being provided continues to meet the standard required
- publishes inspection reports that rate care settings from ‘outstanding’ to ‘inadequate’
- can issue warning notices or fines if standards are not met
What is the EHRC (Equality and Human Rights Commission)
- has a website that provides info, advice and guidance about discrimination
Role of the EHRC:
- provides different definitions of discrimination
- gives advice on how you can decide if what happened is against equality law
- suggests ways you can sort out what happened with organisation or the person
- produces factsheets about discrimination based on the nine protected characteristics
- advises on how to make a complaint
- provides info on how you can take a case to court
What are the main responsibilities of NICE?
- assess new drugs and treatments as they become available
- provide evidence-based guidelines on how particular conditions should be treated
- provide guidelines on how public servcies can best support people
- provide info services for those managing and providing h+s care
- improve outcomes for people using h+s care services
NICE considers whether a drug or treatment:
- benefits patients
- will help the NHS meet its targets, e.g improving cancer survival rates
- is good value for money and cost-effective
- should be available on the NHS
Impact of legislation and national initiatives:
- Encourages a person-centered approach to care and provision
- Individual needs met - checks/monitors/standards
- Promotes empowerment
- Promotes accessible services
- Sets out standard of care required
- Ensures legislation is being followed/law upheld
The provisions of the Equality Act impact on the way staff are selected and interviewed:
- advertisements and interviews must not discriminate against any of the nine protected characteristics
- non discriminatory questions asked
- interviewers trained in equality and diversity - aware of bias and discriminatory practice
- mixed interview panels help avoid bias - age, men, women, experience, ethnicities
How do organisational policies help promote good practice?
- helping service users feel safe and secure
- giving individual rights
- providing a system of redress
- Ensuring staff know their responsibilities and what is expected of them
what is a system of redress?
a way of obtaining justice after receiving inadequate care
- may take the form of compensation awarded by courts/ having rights restored in some way
benefits of staff completeing the care certificate qualification:
- confidence in knowing she can do her job to required standard
- know what it means to be caring
- better understanding of equality, diversity and rights
The equality act 2010:
- makes direct and indirect discrimination based on the nine protected characteristics
- prohibits discrimination in education, employement, access to goods and services and housing
- covers vicitiminsation + harrassment on the basis of protected characteristics

- age
- disability
- gender reassignment
- marriage and civil partnership
- pregnancy

- sexual orientation
The mental capacity act 2005:
- support to make own decisions
- unwise decisions
- best interests
The children act 2004:
- aims to protect children at risk of harm
- the child has a right to be consulted
- children have a right to an advocate
The data protecttion act 1998:
- processsed fairly and lawfully
- accurate and kept up to date
- kept for no longer than neccessary
- not transferred to other countries outside EU
The human rights act 1998:
- right to life
- right to freedom from discrimination
- right to freedom of expression
- right to respect, privacy and family life
