A

What is the evidential test?

A

First stage in the decision to prosecute - CPS must be satisfied that there is Skye Biden evidence to provide a “realistic prospect of conviction”

A

This is the test that is used if a case passes the evidential test. The CPS must decide whether a prosecution is needed in the public interest.

  1. Listen to the question
  2. Make sure you understand the question, ask for repeat / clarity if required
  3. Think carefully about the answer
  4. And the question (and only the question)
  5. Keep answers short and to the point

  8. Be courteous
  9. Admit mistakes
