What is the Safe Person Concept?
A person should be responsible for their own health and safety and the health and safety of others.
What is the Health and Safety at Work Act 1974?
Health and Safety at Work Act 1974
Overarching piece of legislation for Health and Safety in the UK
- Duty to all employers to keep employees safe at work (section 2)
- Policed by the Health and Safety Executive (HSE)
- Injuries and dangerous occurrences must be reported.
What are the Important Sections of HSWA?
Section 2 - Duty on employers to ensure H&S of employees.
Section 3 - Duty to ensure people who are not employees are not exposed to H&S risks.
Section 4 - Duty to ensure premises are safe from risks to health.
Sections 7&8 - Duty on employees to take reasonable care.
What is the Purpose of the HSE?
The body responsible for promoting and enforcing Health, Safety and Welfare.
They also complete research into occupational risks.
What is a Hazard?
A hazard is anything that has the potential to cause harm (a wet floor)
What is a Risk?
A risk is the probability / likelihood that someone will be harmed (slipping on a wet floor)
What is a Risk Assessment?
Legal requirement for organisations employing more than 5 people.
What would you include in a Risk Assessment?
- Identify hazards present
- Identify the people at risk from the hazards
- Evaluate the risk (consider likelihood and severity)
- Record findings
- Review the risk assessment regularly
- Advise those affected by the risk assessment
What is the ‘Six Pack’ of Health and Safety Regulations?
A group of 6 key Health and Safety Regulations introduced in 1993:
1. Management of Health and Safety at Work
2. Display Screen Equipment
3. Manual Handling Operations
4. Personal Protective Equipment and Work
5. Provision and Use of Work Equipment
6. Workplace Health, Safety and Welfare
What is the Fire Safety Act 2021?
Following the Hackitt Review, The Fire Safety Act reforms previous fire safety regulation for multi-occupied residential buildings
The Act requires:
- Regular inspections to lift shafts
- Ensuring evacuation plans are updated
- Residents have e fire safety instructions
- Ensuring flat entrance doors comply with fire ratings
- Clarifying he responsible person or duty-holder
What is a Responsible Person
If you own the premises and it is not under someone else’s control.
If you are the employer and the premises is under your control.
What is an EWS1 Form?
External Wall System Valuation for tall buildings following Grenfell.
Must be undertaken by a “qualified professional”.
Valid for 5 years
Designed to be used for residential properties of any height
Criteria to be considered:
- Height of the building
- Type of cladding
- Presence of balconies
What is the Purpose of the Building Safety Act 2022?
The legislation is to enhance regulations for building safety.
Key Points are:
- The use of combustible cladding has been banned in residential buildings over 18m tall since 2018.
- Definitions of “higher-risk” buildings are clarified: over 18m high, 7 storeys or include 2 or more residential units.
The Internal Fire Safety Standards (IFSS) which are supported by the RICS.
What is a Building Safety Regulator?
A Building Safety Regulator is required to act for:
- Securing the safety of people in or about buildings in relation to risks arising from buildings.
- Improving the standards of buildings.
What is the CDM 2015?
Construction (Design and Management) Regulations 2015
Main set of regulations for Health and Safety in Construction.
It is a criminal offence to break CDM Regulations, policed by HSE.
Key Parts:
- The main duty holders: The Client, The Principle Designer, The Principle Contractor
- All projects with more than 1 contractor must have a Principle Designer, Principle Contractor and H&S File
- Client’s responsibility to ensure CDM requirements are met.
- There is a need for a risk assessment
What is an F10 Form?
Notifiable Period
The HSE must be notified if a project lasts longer than 30 construction days with 20 or more workers or more than 500 person days of construction
