What can you tell me about case law Fogerty v Farjampour?

A

Highlights the problems of not providing an inclusive environment.

The case revolves around a pizza shop which had a step to access. Mr Fogerty was a tetraplegic and could not step up into the premises.
Mr Farjampour offered to bring a menu outside to serve the claimant.
This actually shows a complete lack of empathy on his part with his treatment of a wheelchair user being completely different to anybody else, thus breaching the Equality Act and went to court for thinking it was reasonable to serve a disabled customer from the street. Ordered to Pay a £6,000 compensation. Solution would be a ramp and bell which would cost no more than £100.

It provides requirements such as having a level approach from the boundary of the site and car parking and requires having a level approach where ever possible and a gentle gradient over a long distance where this isn’t possible.

At least one parking bay should be designated as close as feasible to the entrance of the building.

Inclusive design goes beyond meeting building requirements and legislation and includes the setting of the building in the wider built environment.
some examples include
-is the office location accessible -is the natural light
-what’s the transport infrastructure - are fire alarm’s clearly identifiable and is everything well signed posted

How does your compliment requirements for an increase of environment

A

The majority of the VO does fully make requirements for fully inclusive environments

Some improvements could be sentences in toilets rather than taps potentially a separate entrance for disabled persons and job applications shouldn’t include gender an age for example
