  2. Assessments will be challenged overtime, and agreed or determined by Tribunal. Accepted by lack of challenges.
  3. Finally a stage is reached where enough assessments have been agreed or unchallenged and determines a pattern of values, or tone of the list

What reliefs do you know?
Small business relief = RV < £12,000 100% Relief. Then staggered above that so < £15,000 up to 100%relief. Charitable relief = up to 80%, can be up to 100% Empty property relief = 3 months / up to 6 months for warehouses and factories. Vacant for a reason i.e. H&S.

Lord Denning said we admit all relevant evidence. The goodness or badness of it goes to weight, and not to admissibility.

What new legislation was introduced in 2018 regarding heraditaments?
Rating (Property in Common Occupation) and Council Tax (Empty Dwellings) Act 2018. The act makes provision where 2 or more hereditaments occupied or owned by the same person and are contiguous can be treated for non domestic rates purposes as one single hereditaments.

Card tropics v Sykes (VO) [2020] UKSC 21
The Supreme Court considered whether the sites of Automatic Teller Machines (ATMs) in supermarkets were: A) capable of being identified as separate assessments B) in rateable occupation of the host store or the ATM operator. Concluded host stores had not sufficiently parted with possession and therefore the host remained in control and in rateable occupation of the site of the ATM.

Talk me through Monk & Newbigin case what did it establish?
Where a rated property is in capable of beneficial use, having been subjected to significant building works kt should be deleted from the assessment. Or the Rateable Value reduced to a nominal value. Lightweight refub/refits do not qualify for a reduction of rating assessment.

Lotus and Delta 1) the rent of the subject property should be taken as the starting point. 2) more closely to AVD the more weight it gives. 3) Rents of similar properties are relevant. 4) assessments of other comparable properties also relevant. 5) in light of all evidence, opinion can be formed to value. 6) if there are no Rents available, a review of comparable assessmentsay be helpful.

What is the difference between advocate and exert witness(independent expert?
Expert witness has a duty to the panel. And will explain facts and evidence that led to an opinion. Advocate has a duty to the client and will labour's on points to win the case.
