What are the requirements of the OIC in relation to WHS Incident Management - Notifiable Incidents?
Completing an FRV Safe initial report initial report or ensuring that the reporting / injured / affected worker has completed the FRV Safe initial report within 24 hours of an incident occurring.
Completing an FRV Safe Initial report on behalf of a visitor, contractor, subcontractor, or member of the public who is affected by an incident / near miss / hazard.
Notify their Commander or Manager if the incident is notifiable as per appendix A or if the risk rating if rated as high or above.
What is the management of OH & S Incidents, near misses and exposures?
6.1 Immediate response
Eliminate or isolate any remaining hazards at the incident site which may have the potential to cause any immediate further harm, if safe to do so.
Call 000 (if necessary).
Notify Supervisor / Officer in Charge (OIC).
Provide assistance as per 6.1.1 (below) if an injury has occurred.
Supervisor/OIC must immediately notify the relevant Manager/Commander unless the hazard / incident is of a minor nature (e.g., a facility issue requiring rectification):
The Manager / Commander must be provided with information regarding the details of the injured or affected person, the facts of the incident and any medical transport and destination details which are relevant; and
The Manager / Commander must notify the relevant ACFO / Director and relevant Health & Safety Representative as soon as reasonably practicable.
6.1.1 If an injury has occurred:
If necessary to avoid further injury (and if safe to do so) remove injured person(s) from immediate threat of further harm;
Initiate first aid treatment and consider the need for further emergency medical treatment, if required;
Worker and/or Supervisor/OIC must immediately contact FRV Health (1800 378 432) so that triage of the injury, early intervention and appropriate injury management support can be provided. If it is an emergency situation, contact should be made as soon as possible after the event.
Incidents requiring notification to WorkSafe:
the death of a person;
a person requiring medical treatment within 48 hours of exposure to a substance; or
a person requiring immediate treatment as an in-patient in a hospital; or
a person requiring immediate medical treatment for:
the amputation of any part of his or her body; or
a serious head injury; or o a serious eye injury; or
the separation of his or her skin from an underlying tissue (such as degloving or scalping); or
electric shock; or
a spinal injury; or o the loss of a bodily function; or
serious lacerations (This includes, but is not limited to, one or more deep and/or extensive cuts, tears or wounds to the flesh or tissue. The immediate medical treatment required may include stitching to prevent loss of blood and/or other treatment to prevent loss of bodily function and/or infection); or
any other injury to a person or other consequence prescribed by the regulations.
any incident that exposes a person in the immediate vicinity to an immediate risk to the person’s health or safety through the following:
the collapse, overturning, failure or malfunction of, or damage to, any plant that the regulations prescribe must not be used unless the plant is licensed or registered; or
the collapse or failure of an excavation or of any shoring supporting an excavation; or
the collapse or partial collapse of all or part of a building or structure; or
an implosion, explosion, or fire; or
the escape, spillage or leakage of any substance including dangerous goods (within the meaning of the Dangerous Goods Act 1985); or
the fall or release from a height of any plant, substance, or object; or
in relation to a mine:
the overturning or collapse of any plant; or
the inrush of water, mud, or gas; or
the interruption of the main system of ventilation; or
any other event or circumstance prescribed by the regulations.
What are the requirements of the OIC in relation to WorkCover claims ORG 133?
Ensure that the initial FRV Safe report is completed as soon as practical and assigning FRV Safe report to an appropriate investigator.
Completing the initial FRV Safe report when a claimant is unable to do so and assigning FRV safe report to appropriate investigator.
Reporting to the FRV WorkCover claims section any additional information that may assist in making a decision concerning the acceptance of liability.
Resumption of Duty:
All staff returning to work following time off for a work related injury are to obtain a Workcover Certificate of Capacity - Full clearance for pre-injury duties before resuming their pre-injury work. This can be included in a certificate authorising time off (e.g., unfit for duty 28 and 29 October, fit to resume 30 October).
FRV, under its regulations, may also request operational staff to attend the Brigade Medical Services (BMS) to confirm fitness for duty before resuming work.
WorkCover Certificate of Capacity (ORG133):
These must be an authorised WorkCover Certificate of Capacity.
The initial certificate cannot be for a period exceeding 14 days and must be issued by a medical practitioner.
Subsequent WorkCover Certificates of Capacity can be issued by medical practitioners, physiotherapists, osteopaths, or chiropractors for periods of up to 28 days.
The claimant must obtain and submit ongoing WorkCover Certificates of Capacity to FRV WorkCover Claims section to ensure the claimants pay continues. Certificates must be continuous (no overlapping dates or missed dates), and not just covering rostered shift days.
To ensure the WorkCover Certificate of Capacity is valid the claimant must complete the patient declaration on the 2nd page of the certificate. It is advised the person issuing the certificate also witness and date the patient declaration.
