What does section 32 of the policing act and allow police to do after an arrest?
It enables Police to obtain identifying particulars from a person
In lawful custody
Where they are arrested for committing an offense
And are at a police station or any other place being used for police purposes.
What details are we authorized to obtain under the policing act?
Biographical details, such as name, address, date of birth
Photograph
Fingerprints, palm prints, footprints
What does section 33 of the Bail act allow us to do if we intend if please intend on summoning them?
Obtain information from people who we have suspected of committing an offense
And will proceed against by way of summons.
What does section 36 of the Policing
act allow us to do with respect to detox?
This section relates to detox:
It allows us to take someone into custody who we find intoxicated in a public place or private place trespassing.
What conditions must be meant to take someone in for detox?
Found intoxicated in a public place
Or trespassing on a private place
Incapable of protecting themselves
Or likely to cause physical harm to another person
Or a damage property
Not reasonably practical to take them home or to a temporary shelter
How long can we detain someone for detox?
No more than 12 hours
Must be released when they cease to be intoxicated
Can be pushed out over 12 hours by a health practitioner if they are satisfied that they cannot be taken home, to a shelter, do not have other health needs that require medical attention, and remain intoxicated
