what is duty to act
you have an obligation to act within the scope of training
what is standard of care
provide care that a reasonable person with similar training would provide in a similar situation

informed versus expressed versus implied consent
verbal/written, nonverbal/written, unconscious/incompetent
what must you do if an allowed patient refuses care
explain why they need it, what will happen if they refuse, tell them to call 911 if they change their mind, document everything
who must sign a DNR
a physician
power of attorney
appointing someone to make medical decisions if patient cant make them
advanced directive
end of life decisions made in advance so they are known if patient is unable to verbalize them. ex. DNR, organ donation, POA
tort
civil wrongdoings that bring legal action due to resulting injury. ex. negligence, abandonment, failure to transport.
negligence
failure to meet standard of care. to be found guilty requires duty to act, breach of duty (failed standard of care), and proximate causation (emotional or physical).
assault and battery
threat to inflict harm, touching a patient without consent
HIPAA
covers protected info (assessment findings, medical history, medication, treatment, identifying info) and can not be shared unless stated by patient or someone caring directly for them
what should you do at crime scences
only move things if necessary and document what is moved, document anything patient says, cut clothing around holes
what are you required to report as a mandatory reporter
crimes or abuse (child, domestic, elder), gunshot wounds/stabbings, dog bites, car accidents.
