What are some of the key principles that guide police practice in family harm?
Early intervention

Difficulty learning
Mental health or suicidal tendencies

Difficulty forming attachment
When considering bail for a family harm arrest what is of Paramount consideration?
The victim and their family members
If the arrest is for a BOPO, can they be granted Police bail?
No, they must appear in court within 24 hours or as soon as possible
Can a FH arrest be given Police bail?
Yes, but only under the authorization of an NCO and with due consideration to the victim and their family members
If a person is on EM bail
And is then subject to a PSO
What happens to that person?
They are no longer able to stay at their EM bail address and are therefore in breach of their bail conditions
When responding to a FH episode involving a police officer, what two actions must take place?
What roles might that police officer play in the FH episode that affect the supervisor‘s actions?
- Normal police response applies.
- Supervisor refers the matter to wellness.

This will occur in circumstances where a police officer is subject to a PSO, where offending has occurred - victim, or offender, or a final protection order has been issued
In these cases, PPC must be advised
If a police officer is charged with a FH offense, what actions need to be taken by the supervisor?
Report immediately to PPC manager
Welfare and counseling referral through EAP for both victim and offender
Integrity unit will consider their duties
Essay police officer is served a protection order, what actions need to be taken?
Officers who serve it must send a copy to district commander
Employee respondent must report immediately to supervisor

Who can PSO’s apply to?
Any person and a family relationship.
Who can issue a PSO?
Sergeant or S 63 acting Sergeant
What is the immediate effect of a PSO on a bound person?
Vacate address
Surrender weapons/firearms license
Provide a cooling down period of up to 10 days
What are the long-term implications of PSO?
A bound person must not engage in behavior amounting to family harm
They must not contact the person at risk directly or indirectly
If a parenting order exists and a PSO is issued, what happens to the parenting order?
The parenting order is suspended for the duration of the PSO
Under what circumstances would you not be able to issue a PSO?
If a person is **charged with an offense
If a protection order exists and a **breach has been **established
What are the special considerations that I made when considering whether or not to issue a PSO?

In considering an individual’s risk, you can consider the previous dealings with Police, 1M or 1K, propensity for violence and FH history
When considering hardship consider, who has the car, access to money, children with disabilities and the ability for the bound person to comply
To seek authorization for a PSO, what steps must be taken by attending police?
Take steps to identify offenses
Seek authority for PSO
Document the discussion around the decision-making in case it is contested
How long can you detain someone for the purpose of serving a PSO?
Two hours
From the time a PSO’s authorized, but you do not have someone detained,
How long do you have to serve the PSO?
You have 48 hours to serve once authorization is given
If they cannot be located by the time, the PSO expires, they cannot be served
If a person breach is a PSO, what can Police do?
Take them into custody
Bring them to the court within 24 hours
**if you can’t, release them on summons
If someone has breached a PSO and you cannot locate them, how long do you have to locate them to enforce the breach?
1 month
If you cannot find them within one month, the breach is not enforceable
What can the court do if you bring someone in for a breach of PSO?
Continue the order
Direct another PSO to be issued
Adjourn for consideration of a projection order to be issued
**the person at risk must be advised the outcome by the prosecutor ASAP
