The purpose of this order is to outline procedures for investigating Kidnapping and Parental Kidnapping and their individual reporting requirements. This Order supports the core values of "________" and "_________".

Florida State Statute (F.S.S.) 787.01 defines Kidnapping as: “forcibly, secretly or by threat confining, abducting, or imprisoning another person against his or her will and without lawful authority, with intent to:

a. Hold for ransom or reward or as a shield or hostage;

b. Commit or facilitate commission of any felony;

c. Inflict bodily harm upon or to terrorize the victim or another person; or

d. Interfere with the performance of any governmental or political function.

F.S.S. 787.02 defines ______ ________ as “forcibly, by threat or secretly confining, abducting, imprisoning or restraining another person without lawful authority and against his or her will.”

4. Cases not fabricated from domestic disputes and the victim is still missing at the time the incident is reported.

When investigating any mysterious disappearance of a child of tender years (usually considered age 13 or under) or a confirmed non-custodial abduction, the Investigations Division Supervisor will ensure that the ___ is notified.

Federal Bureau of Investigation (F.B.I.)

d. The FDLE Regional Crimes Against Children (CAC), Special Agent Supervisor must approve the activation.

Reporting procedures are as follows:

1. If the offense of kidnapping is committed in conjunction with at least two other reported offenses of the same incident and the victim is still missing at the time of the report, a separate report (with a separate C.C.R. number) will be written for the kidnapping. The Missing Person section of the report will be completed. If there are two offenses being reported and one is kidnapping, both offenses may be recorded on the same report. The Missing Person section will be completed even if the victim has been located or is reporting the offense;

2. The Missing Person section of the General Offense/Incident Report or Supplement Report (for local, previously reported, located victims) shall be completed for ALL kidnapping cases;

3. A NCIC dispatch number shall be obtained as soon as possible for those victims who are not located at the time of the report; and

4. Any vehicle information shall be included in the vehicle section.

In cases of Attempted Abductions or Abductions/Kidnapping where the victim managed to escape or was recovered at the time of the report, officers shall determine (based on the circumstances) the motivation behind the act and:

1. If the circumstances indicate that the motive was likely for robbery, a Robbery Detective will be notified regardless of the age of the victim (examples include: carjacking with the victim being taken in the process, or the suspect demanding money/personal property, etc. as the reason for the abduction)

2. If the circumstances indicate that the motive was potentially sex-related, then a Special Assault Detective shall be notified, regardless of the age of the victim, and

3. If the circumstances indicate that the motive was unknown then,

a. If the victim is 17 years of age or younger, a Special Assault Detective will be notified.

b. If the victim is 18 years of age or older, a Homicide Detective will be notified.

F.S.S. 787.03

F.S.S. 787.03 provides that it is a third degree felony for a spouse or any other person to take or conceal a child or incompetent person with malicious intent to deprive another person of his right to custody of the child or incompetent person. This section further provides that it is a defense to a prosecution if:

1. The suspect reasonably believes that the action was necessary to preserve the child or the incompetent person from danger to their welfare;

2. "The child or incompetent person was taken away at their own instigation without enticement and without purpose to commit a criminal offense with or against the child or incompetent person";

3. It is a case "where a spouse who is the victim of any act of domestic violence or who has reasonable cause to believe they are about to become the victim of any act of domestic violence, as defined in F.S.S. 741.30"; or

4. The suspect believes that the action was "necessary to preserve the child or the incompetent person from danger to their welfare, seeks shelter from such acts or possible acts, and takes with them any child 17 years of age or younger.”

The procedures to enforce a local custody order are as follows:

1. A custody order must contain the following language in order to be enforceable by a law enforcement officer:

a. Language to the effect that the Sheriff shall enforce the provision of the order; and

b. Specific instructions from a judge as to what the Sheriff is directed to do (e.g. go to the husband’s house forthwith to pick up a child and return the child to the mother).

2. Officers shall not enforce a custody order unless the order specifically directs the Sheriff to take a specific action(s).
