What does Article 8 of A201 define?
It defines contract time and conditions for extending the construction schedule.
Under what circumstances can the contractor extend the schedule?
Unforeseeable weather, labor disputes, fire, delays caused by the owner or architect.
What is required for a contractor to request a time extension?
Submit a change order.
What triggers the payment process in Article 9?
Contractor submits an Application for Payment to the architect at least 10 days before the payment date.
What can the architect do upon receiving a payment application?
Certify full payment, certify a partial amount, or withhold payment.
What is substantial completion?
When the work is sufficiently complete for the owner to occupy and use the building.
What are the steps to certify substantial completion?
Contractor submits punch list, architect inspects, architect issues Certificate of Substantial Completion.
What does Article 10 cover?
Contractor’s responsibility for site safety and handling hazardous materials.
Who is responsible for hazardous materials?
The owner, unless the contractor fails to notify about unknown hazards.
What is required insurance for the contractor?
Commercial general liability, workers’ compensation, and any specialty insurances required in Exhibit A of A101.
Who must be named as additional insureds on contractor’s CGL policy?
Owner, architect, and architect’s consultants.
What is a waiver of subrogation?
Agreement that parties won’t sue each other for damages covered by property insurance.
What does Article 12 address?
Uncovering and correction of work.
When can the contractor get additional compensation for uncovering work?
If the architect did not clearly request observation before the work was covered and it complies with contract documents.
How long is the contractor required to correct work?
During construction and up to one year after Substantial Completion.
What is Article 13 about?
Miscellaneous provisions including tests and inspections.
What scenarios allow the contractor to terminate the contract?
Court/government stop orders, nonpayment, or owner’s failure to meet obligations for 60+ days.
What rights does the owner have for termination?
Suspend or terminate for convenience or for cause.
What happens if the owner terminates for convenience?
Contractor is paid for completed work, termination costs, and fee stated in A101.
What happens if the contractor is terminated for cause?
They receive no termination fee.
What is the dispute resolution process in Article 15?
Initial Decision Maker → Mediation → Binding Dispute Resolution (arbitration/litigation).
What is the deadline to file claims under A201?
Within 21 days of the event and no more than 10 years after Substantial Completion.
